Allah says in the Quran:

OBEY ALLAH, OBEY THE PROPHET AND OBEY THOSE IN AUTHORITY AMONG YOU.

This ayah clearly depicts that Islamic laws are to be based on the Quranic teachings and Sunnah.

ISLAMIC DEMOCRACY:

The Islamic System of democracy depends on the three basic principles of Constitution, Consent and Consultation.

1. CONSTITUTION:

The constitution of Medina is a perfect example of an Islamic democratic ruling as The Holy Prophet ﷺ was not only the leader but He was also the political head of the state of Medina.

It was a social contract which converged the people’s individual sovereignty to a collective one hence The constitution defined a law that governs the state of Medina

2. CONSENT:

Constitution of Medina with mutual consent appointed Prophet Muhammad as a head of the government.

In the time of the Holy Prophet ﷺ, to entrust governance to a person was through the process of Bayah or pledging of allegiance to a person who one found suitable to be the head of the state.

The Holy Quran too acknowledges the authority of chosen representatives and commands the believers to obey them in the following words:

O YOU WHO BELIEVE! OBEY ALLAH AND OBEY THE MESSENGER AND THOSE IN AUTHORITY FROM AMONG YOU.

[Quran 4:59]

3. CONSULTATION:

Islamic democratic government which is commonly known as Shura is a concept and the fundamental evidence of Islam’s support to democracy. The Holy Quran says:

  …AND CONSULT THEM IN AFFAIRS (OF MOMENT). THEN, WHEN THOU HAST TAKEN A DECISION PUT THY TRUST IN ALLAH.

[Quran 3:159]

[RIGHTEOUS ARE THOSE] …WHO CONDUCT THEIR AFFAIRS THROUGH [SHURA BAYNAHUM] MUTUAL CONSULTATION.

[Quran 42:38]

Muslims favoring democracy consider it necessary while the anti-democratic Muslims support the idea of it being a suggestion.

The Prophet Muhammad ﷺ also consulted at many occasions during his governance. His quote that:

THE COMMUNITY OF MUHAMMAD SHALL NEVER AGREE UPON AN ERROR

suggests that He ﷺ promoted Shura and gave it primary importance.

The present-day democratic system supports the concept of consultation of mutual consent as well.

HOW TO CREATE AN ISLAMIC GOVERNMENT:

It is necessary that the ruling class are true supporters of democracy in order to implement the Islamic system of governance in real life .They should be well aware of the principles of governance that Islam has defined and they also need to have studied the Holy Quran in detail. They can successfully construct an Islamic Republic by consulting these resources regularly. Some principles are defined below which can be used as the building blocks of an Islamic state:

  1. It is absolutely necessary that laws defined is according to the Holy Quran and implemented by the Holy Prophet ﷺ during His governance.
  2. There should be mutual consent of representatives during the steps taken to govern
  3. An Islamic state demands that all its policies be decided by the process of consultation. The government must ensure the proper implementation of this process.
  4. The Basic Principles of a Muslim society e.g. justice, equality, honesty, freedom etc. should be implemented.
  5. The accountability of ones acts should be ensured for all the citizens.
